⭐ Terms and Conditions
Definitions:
• “Agency” refers to Elisa’s London Nannies Limited, 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, UK.
• “Client” refers to the person(s) who engages the Agency to be introduced to a Candidate for potential employment, agreeing to these Terms and Conditions and the Fee Structure.
• “Candidate” is any job seeker introduced to the Client by the Agency for potential employment.
• “Introduction” means when the Agency shares a Candidate's contact details with the Client, whether verbally, electronically, or in writing, with the intent of employment.
• “Engagement” means the Client's decision to employ a Candidate on any basis (permanent, temporary, full-time, part-time, rota, or trial).
• “Registration” refers to the Client’s confirmation via email to proceed with the services, which constitute acceptance of these Terms and Conditions and the Fee Structure.
Terms of Service:
• These Terms and Conditions form a binding contract between Elisa’s London Nannies and the Client.
• By confirming via email or engaging with the Agency (by phone, email, or website), the Client agrees to these Terms and the Fee Structure.
• If the Client does not accept these Terms, they should not proceed with any services from the Agency.
Agency Services:
• The Agency will use reasonable care to introduce suitable Candidates based on the Client’s specified requirements (e.g. hours, days, duties).
• While the Agency undertakes thorough vetting—including right-to-work checks, verified references, and review of relevant supporting documents—it aims to obtain a minimum of two references where reasonably possible. Where a Candidate has worked long-term for a single family or where previous employers are not contactable (e.g., relocation abroad), only one reference may be available. The Agency cannot guarantee a Candidate’s suitability.
• The Agency can provide guidance on interview techniques, suggested questions, and best practices if requested.
Client Responsibilities:
• The Client is responsible for:
The Agency obtains and shares references provided by the Candidate with the Client. However, the Client is strongly advised to verify these references independently and conduct any further checks they deem necessary before proceeding with employment.
Checking original documents (e.g. passports, visas, qualifications).
Ensuring the Candidate has the legal right to work in the UK (or overseas, where applicable).
Conducting any health checks or background checks they deem necessary.
• The Client is the employer, responsible for:
Issuing an employment contract.
Managing payroll, tax, National Insurance, and pension contributions.
Ensuring compliance with employment laws.
Obtaining employer’s liability insurance (recommended).
• The Agency is not the employer of any Candidate introduced.
Engagement and Payment:
• The Client agrees to notify the Agency immediately upon offering a position to a Candidate, including the agreed salary, start date, and duration.
• Invoices are issued upon acceptance of an offer (not the start date). Payment is due within 7 days or before the Candidate starts—whichever comes first.
• If payment is delayed, the Agency reserves the right to apply 5% interest per week (or part thereof) until settled, plus any legal costs incurred.
• The fee is based on the initial minimum requirements provided by the Client at the start of the search.
Confidentiality & Introduction Obligations:
• All Candidate introductions are strictly confidential.
• If the Client refers a Candidate to another person, household, company, or third party within 48 months, resulting in an engagement, the Client is liable for the full placement fee.
Refund & Replacement Policy:
• If a Candidate cancels before starting, the Client may choose between:
A full refund or
A full free replacement.
• If the Client cancels before the start date, 50% of the paid fee is refunded, provided the invoice was settled.
• If the engagement ends within 12 weeks, the Agency offers:
Unlimited free replacements during this period.
If no suitable replacement is found within a reasonable time:
Weeks 1–2: 90% refund
Weeks 3–6: 50% refund
Weeks 7–12: 25% refund
After 12 weeks, no refund or replacement applies.
Liability Disclaimer:
• The Agency is not liable for:
Any loss, damage, expenses, disputes, or claims arising from the engagement of a Candidate.
Misrepresentation, negligence, misconduct, or dishonesty by a Candidate.
• The final decision to engage a Candidate rests solely with the Client.
